STREET RULZ FOOTBALL — PARTICIPATION WAIVER, RISK WARNING & RELEASE

Applies to every participant, child and spectator. One signature covers all future visits.

1. Who this agreement is with

Two related organisations operate from the same premises at 40 Andrews Road, Tallebudgera. This waiver is given to both of them together and to each of them separately:

• Street Rulz Football Pty Ltd and The Trustee for Munro Family Trust (ABN 60 728 302 749), trading as Street RULZ Football — the commercial operator: pitch hire, casual sessions, birthday parties, the canteen, coaching and the senior competitions.
• Munro Community Sport Incorporated (ABN 51 890 169 734) — the not-for-profit association: community programs, junior participation, inclusion programs and grant-funded activities.

Both trade as “Street RULZ Football”. In this document “we”, “us”, “our” and “the Providers” mean both organisations, and every reference to us is a reference to each of them jointly and severally.

“Associated Persons” means our officers, directors, committee members, employees, volunteers, coaches, referees, party hosts, contractors and agents, the owner of the land on which the facility sits, and other participants.

2. Activities covered

This waiver applies to all activities at, or organised by, the facility, including but not limited to:

• 5-a-side, 7-a-side and all small-sided football, social and competitive
• Leagues, tournaments, finals, grading nights, casual kick sessions and pitch hire
• Training, coaching, clinics, holiday programs and camps
• Birthday parties, corporate events, school and group bookings
• Use of the pitches, cages, rebound walls, perimeter netting, goals, equipment, clubhouse, canteen, car park, viewing areas and walkways
• Spectating anywhere inside the perimeter

(collectively, the “Activities”).

3. Risk warning

This clause is a risk warning for the purposes of the Civil Liability Act 2003 (Qld).

Street RULZ is a fully enclosed, caged, floodlit facility with rebound walls, perimeter netting and an artificial grass (synthetic turf) playing surface. Football and active recreation in this environment carry obvious and inherent risks, including:

• Collision with the rebound walls, cage fencing, netting, net supports, goal frames or posts — the playing area is enclosed, so there is little or no run-off space at the boundary and players may make contact with the perimeter at speed
• Being struck by a ball rebounding off a wall, the cage or the netting at speed, at an unpredictable angle, and from outside your field of view
• Injury from the artificial grass surface — friction burns, abrasions and grazes; a firmer surface than natural turf; footwear gripping, catching or sliding unexpectedly; a slippery surface when wet; and significantly elevated surface temperature in hot or sunny conditions
• Collisions with other players, falls, slips and trips
• Sprains, strains, fractures, dislocations, lacerations, dental and eye injuries
• Concussion and other head injury, including from contact with the ball, another person, the ground or the perimeter structures
• Heat illness, dehydration, cardiac events, and the aggravation of any pre-existing injury or condition
• Injury caused by the actions, inexperience, misjudgement or deliberate conduct of other participants
• Reduced visibility or depth perception under floodlights at night
• Injury in the car park, walkways, clubhouse or canteen areas
• In rare cases, permanent disability or death

These risks cannot be completely eliminated, and we do not represent that they can. By entering the facility or taking part, you voluntarily accept and assume them.

3A. Obvious risk, inherent risk and dangerous recreational activity

You acknowledge and agree that:

• The risks described in clause 3 are obvious risks within the meaning of section 13 of the Civil Liability Act 2003 (Qld);
• You are presumed to be aware of those obvious risks under section 14, whether or not you are aware of their precise nature, extent or manner of occurrence;
• Under section 15, we owe you no proactive duty to warn of an obvious risk;
• Under section 16, we are not liable in negligence for the materialisation of an inherent risk — a risk of something occurring that cannot be avoided by the exercise of reasonable care and skill;
• Competitive and contact football played in an enclosed cage is a dangerous recreational activity, and under section 19 we are not liable in negligence for harm suffered as a result of the materialisation of an obvious risk of that activity, whether or not you were aware of the risk.

3B. Everyone on site is bound

This risk warning is also displayed on signage at the entrance and throughout the facility. Every person who enters — participant, spectator, guest or visitor, and whether or not they have signed this document — enters on these terms and is given this risk warning.

4. Your promises

You confirm that:

• You are 18 or over, or you are the parent or legal guardian of each child named below;
• You and any child you sign for are physically fit to take part, and you have disclosed all relevant medical conditions, injuries, allergies and medications;
• You will not take part while injured, unwell, concussed, or against medical advice, and will not return to play after a suspected concussion without medical clearance;
• You will follow all rules, signage, referee decisions and staff instructions;
• You will not take part under the influence of alcohol or drugs;
• You will wear shin pads where required and bring your own water.

4A. Footwear — artificial grass facility

Street RULZ is an artificial grass (synthetic turf) facility.

• Turf or astro boots are the correct and recommended footwear.
• Moulded or studded football boots are permitted.
• Metal studs, screw-in metal tips and blades are never permitted. They damage the surface and create a serious risk of injury to you and to others. Anyone wearing them will be refused entry to the playing area.
• Bare feet, thongs, sandals and open footwear are not permitted on the pitches.
• Any other footwear is worn at your own risk.

4B. Emergency, fire and flood

Evacuation diagrams are displayed at the facility. In an emergency you must follow staff directions immediately and move to the designated assembly point. If you are responsible for a child, you remain responsible for that child during an evacuation. Our Fire and Flood Evacuation Policy is published on our website and forms part of these terms.

5. Medical consent

You authorise our staff to arrange first aid, ambulance or medical treatment for you or your child if they reasonably consider it necessary, and you accept responsibility for the cost of that treatment and transport.

6. Release and indemnity

To the fullest extent permitted by law, and in consideration of being permitted to enter the facility and take part, you:

(a) Release the Providers and their Associated Persons from all liability for personal injury, illness, death, loss or property damage arising from or connected with the Activities or your presence at the facility.

(b) Indemnify the Providers and their Associated Persons (including legal costs on a full indemnity basis) against any claim, demand, action or expense arising from your or your child’s participation, conduct or presence, including any claim brought by a third party.

(c) Agree that this release and indemnity is given to each Provider separately as well as to both together, and continues to operate for each of them even if it is found unenforceable in relation to the other.

(d) Agree to reimburse us for any loss or damage you or your child cause to the facility, the surface, the rebound walls, the netting, equipment or another person’s property through deliberate, reckless or negligent conduct.

6A. Recreational services — exclusion of consumer guarantees

The Activities are recreational services as defined in the Australian Consumer Law.

To the maximum extent permitted by section 139A of the Competition and Consumer Act 2010 (Cth), the consumer guarantees that would otherwise apply to the supply of those recreational services are excluded, restricted or modified, so that we are not liable for death, physical or mental injury, or the contraction or aggravation of any disease or condition, arising from the supply of those services.

This exclusion does not apply to significant personal injury caused by our reckless conduct, and does not exclude any right or remedy that cannot lawfully be excluded.

6B. What we cannot exclude

Nothing in this waiver excludes, restricts or modifies any right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified — including the non-excludable guarantees under the Australian Consumer Law, and any duty that cannot lawfully be delegated or contracted out of. Where a liability can be limited but not excluded, our liability is limited to resupplying the relevant service or paying the cost of resupply.

6C. Our Terms & Conditions apply as well

Our published Terms & Conditions and Fire and Flood Evacuation Policy are incorporated into and form part of this agreement. If there is any inconsistency between this waiver and those documents on a question of liability, risk or safety, this waiver prevails.

7. Children under 18

If you are signing for a child, you:

• Confirm you are their parent or legal guardian with authority to bind them;
• Consent to them taking part in the Activities now and on future visits;
• Give the release and indemnity in clause 6 on your own behalf and on theirs;
• Agree to provide or arrange appropriate adult supervision as required, and to collect them at the published time for any supervised program.

8. Evergreen — one signature covers future visits

This waiver applies to every visit, booking, session, program and event at the facility, and continues until you revoke it by written notice to admin@rulz.com.au. Revocation takes effect only for visits occurring after we receive it.

9. Privacy

We collect the information on this form to run the Activities safely, to contact you, and to meet our legal and insurance obligations. We store it securely and do not sell it. You may request access or correction by emailing admin@rulz.com.au.

10. General

• Governing law: Queensland. You submit to the non-exclusive jurisdiction of its courts.
• Severability: if any part of this waiver is held invalid or unenforceable, it is to be read down so far as necessary to make it valid; if it cannot be read down, it is severed and the remainder continues in force.
• Separate entities: if any part is unenforceable in relation to one Provider, it continues to apply in full to the other.
• Entire agreement: together with the documents incorporated by clause 6C, this is the entire agreement between us about the matters it covers.

11. Acknowledgement

By signing below, electronically or by hand, you confirm that:

• You have read and understood this entire document, including the risk warning in clause 3 and the release in clause 6;
• You accept its terms freely and voluntarily, and have had the opportunity to obtain independent legal advice;
• You understand that you are giving up important legal rights, including the right to sue;
• Your electronic signature or tick has the same legal effect as a handwritten signature.
